1. Acceptance of Terms

By downloading, installing, accessing, or using the ARS Instructor Field Guide mobile application ("ARS FOG" or the "App"), you acknowledge that you have read, understood, and agree to be bound by these Terms of Service ("Terms") and our Privacy Policy, which is incorporated into these Terms by reference.

If you do not agree to these Terms, do not download, install, or use the App. If you have already installed the App and do not agree to these Terms, you must uninstall it from your device.

2. Description of the App

ARS FOG is a digital reference tool developed by Advanced Rescue Solutions LLC ("ARS," "we," "our," or "us"), located in Greenwood, Indiana, United States. The App provides trained rescue professionals with access to:

• A digital field guide covering technical rescue disciplines (4th Edition)
• Specialized rescue calculators for field estimations
• Links to external emergency resources and hotlines

The App is a digital companion to the physical ARS Technical Rescue Field Guide, 4th Edition, and is designed to function primarily offline without an internet connection.

3. Eligibility

The App is intended for use by trained professional rescue personnel, including but not limited to firefighters, emergency medical technicians (EMTs), technical rescue team members, hazardous materials responders, and other first responders who have received formal training in the rescue disciplines covered by the App.

You must be at least 17 years of age to use the App. By using the App, you represent and warrant that you meet this age requirement.

5. License Grant

Subject to your compliance with these Terms, ARS grants you a limited, non-exclusive, non-transferable, non-sublicensable, revocable license to download, install, and use the App on a mobile device that you own or control, solely for your personal, professional use as a trained rescue professional.

This license does not allow you to:

• Redistribute, sublicense, lease, lend, sell, or resell the App or any of its content
• Copy, reproduce, screenshot, photograph, or duplicate any content from the App in any form or medium for distribution
• Reverse engineer, decompile, disassemble, or attempt to derive the source code of the App
• Modify, adapt, translate, or create derivative works based on the App or its content
• Use the App's content to create competing products, publications, or training materials
• Use the App's content for commercial training, instruction, or educational purposes without prior written authorization from ARS
• Remove, alter, or obscure any copyright, trademark, or other proprietary notices contained in the App
• Share your App access with others or allow others to use the App through your device purchase

6. Purchases and Payments

The App is available for purchase through the Apple App Store and Google Play Store. All purchases are processed by the respective platform provider (Apple Inc. or Google LLC), not directly by ARS.

• Pricing: The purchase price of the App is displayed on the applicable app store listing and may vary by region. All prices are inclusive of applicable taxes as determined by the app store provider.
• Payment: Payment is processed by Apple or Google according to their respective payment terms. ARS does not directly process payments or have access to your payment information.
• Refunds: Refund requests are handled by the app store from which you purchased the App, in accordance with their refund policies. Please contact Apple Support or Google Play Support for refund inquiries.
• Bulk licensing: For agency or department-wide purchases, please contact ARS directly through advancedrescue.com/contact-us.

7. Intellectual Property

All content within the App — including but not limited to text, diagrams, photographs, illustrations, page layouts, calculator algorithms, icons, and user interface design — is the property of Advanced Rescue Solutions LLC or its licensors and is protected by United States and international copyright, trademark, and other intellectual property laws.

The App incorporates content used under license or with permission from the following sources:

• vRigger software (Iterum LLC, vrigger.com)
• US Army Corps of Engineers
• FEMA, FOG, and SOG manuals
• Holmatro Inc (equipment images)
• Paratech Inc (equipment images)
• Advanced Rescue Solutions LLC (original diagrams and photographs)

"Advanced Rescue Solutions," "ARS," the ARS shield logo, and "ARS FOG" are trademarks or trade names of Advanced Rescue Solutions LLC. All other trademarks, service marks, and trade names used in the App are the property of their respective owners.

8. Calculator Disclaimer

The 13 rescue calculators provided in the App — including unit conversions, SAE/metric/decimal conversions, concentration conversions, collapse weight estimation, weight estimators, fallen tree weight, triangle/lever calculations, A-frame gantry, trench depth/weight, shore spacing, raker length, confined space air exchange, and water flow calculations — are tools to assist with field estimations only.

ARS is not responsible for errors in calculations, incorrect inputs, misinterpretation of results, or any consequences arising from the application of calculator results in the field or otherwise.

9. User Conduct

You agree to use the App only for its intended purpose as a professional rescue reference tool. You agree not to:

• Use the App for any unlawful purpose or in violation of any applicable local, state, national, or international law
• Attempt to gain unauthorized access to any portion of the App, its systems, or networks
• Interfere with or disrupt the integrity or performance of the App
• Use the App in any way that could endanger yourself or others beyond its intended use as a supplemental reference

10. Limitation of Liability

IN NO EVENT SHALL ARS'S TOTAL LIABILITY TO YOU FOR ALL CLAIMS ARISING OUT OF OR RELATING TO THE APP EXCEED THE AMOUNT YOU PAID FOR THE APP. Proper training and guidance from qualified instructors is required before applying any techniques referenced in this App. You assume full responsibility for your use of the App and its content.

11. Disclaimer of Warranties

THE APP AND ALL CONTENT, CALCULATORS, DIAGRAMS, PHOTOGRAPHS, AND REFERENCE MATERIALS ARE PROVIDED "AS IS" AND "AS AVAILABLE" WITHOUT WARRANTIES OF ANY KIND, WHETHER EXPRESS, IMPLIED, OR STATUTORY. TO THE FULLEST EXTENT PERMITTED BY LAW, ARS DISCLAIMS ALL WARRANTIES, INCLUDING BUT NOT LIMITED TO IMPLIED WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, ACCURACY, RELIABILITY, COMPLETENESS, AND NON-INFRINGEMENT.

ARS DOES NOT WARRANT THAT: (A) THE APP WILL BE UNINTERRUPTED, TIMELY, SECURE, OR ERROR-FREE; (B) THE CONTENT WILL BE ACCURATE, RELIABLE, COMPLETE, OR CURRENT; (C) THE APP WILL BE FREE OF VIRUSES OR OTHER HARMFUL COMPONENTS; OR (D) THE APP WILL MEET YOUR SPECIFIC REQUIREMENTS OR EXPECTATIONS.

The App contains links to third-party websites, telephone services, and resources for emergency and informational purposes, including:

• ChemTrec (24/7 HazMat emergency response)
• Poison Control (24/7 poison guidance)
• DOT Emergency Response Guidebook (PHMSA)
• Manufacturer Emergency Response Guides
• USGS Maps
• Google Translate

These links are provided for convenience and informational purposes only. ARS does not control, endorse, or assume responsibility for the content, availability, accuracy, legality, or practices of any third-party sites, services, or resources. Your use of third-party resources is entirely at your own risk and subject to the respective third party's terms, conditions, and privacy policies.

The inclusion of any link does not imply affiliation, sponsorship, or endorsement by ARS of the linked resource or its operator.

13. App Store Terms

Your use of the App is also subject to the terms and conditions of the platform from which you downloaded it. You acknowledge and agree that:

• These Terms are between you and Advanced Rescue Solutions LLC only, and not with Apple Inc., Google LLC, or any other app store provider (each, an "App Store Provider").
• ARS, not the App Store Provider, is solely responsible for the App, its content, maintenance, support services, and any warranties (to the extent not effectively disclaimed).
• The App Store Provider has no obligation whatsoever to furnish any maintenance or support services with respect to the App.
• In the event of any failure of the App to conform to an applicable warranty, you may notify the App Store Provider, and the App Store Provider may refund the purchase price (if any) for the App to you. To the maximum extent permitted by law, the App Store Provider has no other warranty obligation with respect to the App.
• ARS, not the App Store Provider, is responsible for addressing any claims by you or any third party relating to the App or your possession and use of the App, including but not limited to: (i) product liability claims; (ii) any claim that the App fails to conform to any applicable legal or regulatory requirement; and (iii) claims arising under consumer protection, privacy, or similar legislation.
• In the event of any third-party claim that the App or your possession and use of the App infringes that third party's intellectual property rights, ARS, not the App Store Provider, shall be solely responsible for the investigation, defense, settlement, and discharge of any such intellectual property infringement claim to the extent required by these Terms.
• The App Store Provider and its subsidiaries are third-party beneficiaries of these Terms. Upon your acceptance of these Terms, the App Store Provider will have the right (and will be deemed to have accepted the right) to enforce these Terms against you as a third-party beneficiary thereof.

In the event of any conflict between these Terms and the applicable App Store Provider's terms of service, the App Store Provider's terms shall govern to the extent of the conflict.

14. Support and Maintenance

ARS may, at its sole discretion, provide updates, bug fixes, or new features for the App. ARS is under no obligation to provide any maintenance, technical support, or updates for the App. Any updates provided will be subject to these Terms unless accompanied by separate terms.

15. Indemnification

You agree to indemnify, defend, and hold harmless Advanced Rescue Solutions LLC, its owners, officers, directors, employees, instructors, agents, contractors, and licensors from and against any and all claims, liabilities, damages, losses, costs, and expenses (including reasonable attorney's fees and court costs) arising out of or in any way connected with: (a) your use or misuse of the App; (b) your violation of these Terms; (c) your violation of any applicable law, rule, or regulation; or (d) your violation of any rights of a third party.

16. Termination

ARS may terminate or suspend your license to use the App at any time, with or without cause, and with or without prior notice. Upon termination, you must immediately cease all use of the App and delete all copies from your devices.

The following sections shall survive any termination or expiration of these Terms: Sections 4 (Safety Disclaimer), 7 (Intellectual Property), 8 (Calculator Disclaimer), 10 (Limitation of Liability), 11 (Disclaimer of Warranties), 13 (App Store Terms), 15 (Indemnification), 17 (Governing Law), and 19 (Entire Agreement).

17. Governing Law and Dispute Resolution

These Terms shall be governed by and construed in accordance with the laws of the State of Indiana, United States, without regard to its conflict of law principles. Any legal action, suit, or proceeding arising out of or relating to these Terms or the App shall be instituted exclusively in the state or federal courts located in Marion County, Indiana, and you irrevocably consent to the personal jurisdiction of such courts and waive any objection to venue in such courts.

18. Severability

If any provision of these Terms is found to be unenforceable, invalid, or illegal by a court of competent jurisdiction, that provision shall be modified to the minimum extent necessary to make it enforceable, or if modification is not possible, shall be severed from these Terms. The invalidity or unenforceability of any provision shall not affect the validity or enforceability of the remaining provisions, which shall continue in full force and effect.

19. Entire Agreement

These Terms, together with our Privacy Policy and any applicable App Store Provider terms, constitute the entire agreement between you and Advanced Rescue Solutions LLC regarding your use of the App. These Terms supersede all prior or contemporaneous agreements, communications, and proposals, whether oral or written, between you and ARS regarding the App.

20. Updates to These Terms

ARS reserves the right to modify these Terms at any time. Material changes will be reflected by updating the "Effective date" at the top of this page. We may also provide notice of material changes through the App Store listing or within the App. Your continued use of the App following the posting of revised Terms means that you accept and agree to the changes. If you do not agree to the revised Terms, you must stop using the App and uninstall it from your device.
